Please be advised that under phase 2 of Mandatory E-filing by the Land Title & Survey Authority, a release of a Certificate of Pending Litigation (CPL) Land Title Act sec 252-258 filed with a Form 17, will not be mandatory after May 7th 2012. Supporting applications for a release of CPL by Form 17 include but are not limited to: Originally signed letter from Solicitor or Petitioner where the actions is neither discontinued nor dismissed, Court Certified copy of court order, or Certificate of the Court.
Phase 1, effective January 16, 2012, included Form A Transfers of Fee Simple, Form B Mortgages, Form C Charges (without plan), and Form C Releases (without plan).
Phase 2, effective May 7, 2012, will include Claim of Builders Lien, Form 17’s, certain survey plans, along with forms and applications under the Strata Property Act, SBC 1998, c. 143.
