New form of Certificate of Pending Litigation

Form 33-Certificate of Pending Litigation (Land Title Act section 215(6))

The Director has approved a new form of Certificate of Pending Litigation for use in applications under Land Title Act section 215(6) which are submitted in hard copy or where designated in Bulletin 104 as supporting documents, in electronic form. The new form is set out in the appendix attached to this practice note. It replaces the “Form 33 – Certificate of Pending Litigation” found in Schedule A of B.C. Reg. 334/79, Land Title Act Regulation.

The new form is required as a result of repeal of the Supreme Court Rules and their replacement with the Supreme Court Civil Rules, effective July 1, 2010. The change removes the current reference to Supreme Court Rule 60(22); the form is not changed in any other respect.

The new form is approved for use effective July 1, 2010. Applications which use the previous version of the form will continue to be accepted provided they were completed by the registrar of the court prior to July 1, 2010.
