Dye & Durham is pleased to provide the 2nd of our Monthly Litigation Calendars for 2010, a quick and easy way to see what’s happening in Court for the month of February.

This month’s calendar covers Supreme Courts within the Lower Mainland and Victoria, and is colour coded to distinguish between registries.

 

LITIGATION REMINDERS:

All consent orders require a Requisition (Form 56) to be filed with it (original plus one (1) copy) and backing sheets are required to be attached to ALL orders and defaults.

Vancouver Trial Division will only accept the following documents for filing at the counter: Trial Certificates, Jury Notices and Application materials set for the next day.  All other documents will be submitted to the registry and will be returned within 2 – 3 days depending on the volume at the registry.

The New Westminster Court Registry requires an original plus three copies of both the Notice of Motion and Notice of Hearing when filing.

The New Westminster Court Registry requires that when resetting chambers applications a requisition and a FILED copy of the Notice of Motion MUST be attached.

The New Westminster Court Registry requires that the Jurat on Affidavits MUST be CLEARLY written or stamped as to who the commissioner was who swore the Affidavit.  Affidavits which are unclear will be rejected by the registry.

 

ETRAY™ REMINDERS:

When submitting documents for filing via ETRAY™, please convert your document from word to pdf before you upload them.  If you are scanning your documents, scan each document individually.

Clients using ETRAY™ to file documents on CSO should note that the CSO system limits size of the files to 8MB. 

When submitting an Affidavit for electronic filing, each Affidavit submitted must be accompanied by a Form 144 – Electronic Filing Statement.  Financial Statements being filed electronically also require a Form 144 for filing. Electronic filing statements must include action number, registry and style of cause. Clients using ETRAY™ to file electronically on Court Services Online (CSO) should be advised that it is not possible to file documents from one court registry in another court registry.  CSO is currently not designed to allow court file numbers to be submitted in alternate registries.  Documents in these cases must be filed in hard copy only.
