Change to Notices of Trial – Civil (Form 40) & Family (Form F44) 

As advised in our FYI of last week, as a result of amendments to the Supreme Court Civil Rules that came into effect on July 1, 2015, the following line has been deleted from Form 40 in Appendix A (notices of trial): “I undertake to pay all hearing fees payable under Appendix C, Schedule 1, Item 10.”

The same change is also applicable to Form F44 (notices of trial) as a result of amendments to the Supreme Court Family Rules that also came into effect on July 1, 2015.

Kindly ensure you make this change to your forms before submitting them to Dye & Durham for filing.

If counsel is unable to sign a notice of trial, someone else in the firm (e.g. paralegals, legal assistants, other lawyers) may sign it on his or her behalf. That person should sign their own name (instead of writing counsel’s name in quotes) and write “for” or “per” next to counsel’s name below the signature line.

The registry will not accept notices of trial signed by Dye & Durham, as agent.
