Change to Notices of Trial

Please note that further to the recent amendments to the Supreme Court Civil Rules that came into effect on July 1, 2015, Form 40 in Appendix A (notices of trial) is amended by striking out “I undertake to pay all hearing fees payable under Appendix C, Schedule 1, Item 10.”

Kindly ensure you make this change to your forms before submitting them to Dye & Durham for filing.

If counsel is unable to sign a notice of trial, someone else in the firm (e.g. paralegals, legal assistants, other lawyers) may sign it on his or her behalf. That person should sign their own name (instead of writing counsel’s name in quotes) and write “for” or “per” next to counsel’s name below the signature line.

The registry will not accept notices of trial signed by Dye & Durham, as agent.
